Per Election Code §2.002 –
a. (f) – Tying candidates may agree to cast lots to resolve the tie. The agreement must be written and filed with the authority responsible for ordering the election. – ACTION
OR
b. (g) – Tying candidates may resolve the tie by filing a written statement of withdrawal with the authority responsible for ordering the election. – ACTION
6. Automatic Recount (required ONLY IF Agenda Item # 4a) or 4b) is not completed)
a. (i) – If the tie vote is not resolved under subsection (f) and (g), an automatic recount shall be conducted in accordance with Chapter 216 before the second election is held.
b. Initiate Automatic Recount Per Section 216.003 – the authority designated under Section 212.026 shall request the recount in the same manner as a recount petitioner under this title. - ACTION
