Shelby County Grand Juries Indict Over 100 Cases in August

September 17, 2018 - Two Shelby County Grand Juries handed down over 100 indictments during the month of August. The grand juries were impaneled for the July 2018 term of the 123rd Judicial District Court.

  1. Korey Lanier McClure was indicted for official oppression, misdemeanor a; bribery, second degree felony; and abuse of official capacity, misdemeanor a. The content of the indictments can be read at the following link: Former Shelby County Jailer Indicted, Arrested on Three Charges 
  2. Jenny Hicks was indicted for theft, third degree felony and abuse of official capacity, state jail felony. The content of those indictments can be read at the following link: Hicks Indicted for Theft, Abuse of Official Capacity 
  3. Daniel Dearing Jr. was indicted for tampering with or fabricating physical evidence, third degree felony. The indictment alleges on November 8, 2017 Dearing, while knowing an investigation for a missing person and or the murder of Brandi Wright was pending or in progress, or knew an offense had been committed (burglary, theft, and/or criminal homicide/attempted criminal homicide,) he altered, destroyed, or concealed a silver .357 revolver and hid said revolver in an upstairs room at the residence of Ronnie Borders and/or instructed another individual to move the revolver with intent to impair its verity or availability as evidence in the investigation.
  4. Daniel Dearing Jr. was indicted for tampering with or fabricating physical evidence, second degree felony. The indictment alleges on October 25, 2017 Dearing, while knowing an investigation for a missing person and or the murder of Brandi Wright was pending or in progress, or knew an offense had been committed (burglary, theft, and/or criminal homicide/attempted criminal homicide,) he altered, destroyed, or concealed the human corpse of Brandi Wright, by burying the human corpse, with intent to impair its verity or availability as evidence in the investigation.
  5. Katina Marshay Evans was indicted for escape, third degree felony. The indictment alleges on June 26, 2018 Evans escaped from custody of the Center Police Department when she was under arrest, lawfully detained, charged with, or convicted of an offense.
  6. Katina Marshay Evans was indicted for arson, first degree felony. The indictment alleges on July 26, 2018 Evans had intent to damage or destroy a building that is a habitation, located at 1020 Shelbyville Street (Center Police Department), start a fire, or cause an explosion. The indictment further alleges this was done by lighting trash and a toilet paper roll on fire, knowing the building was within the limits of an incorporated city or town, namely, Center, Texas, and/or is a building that is located on property that belongs to another.
  7. Katina Marshay Evans was indicted for arson, first degree felony. The indictment alleges on July 8, 2018 Evans had intent to damage or destroy a building that is a habitation, start a fire, or cause an explosion by setting bedding and a uniform on fire. Knowing the said habitation was located on property belonging to another, namely, the Shelby County Jail at 100 Hurst Street, Center, Texas.
  8. Joshua Dean Dupree was indicted for burglary of a habitation, second degree felony. The indictment alleges on May 21, 2018 Dupree entered a habitation without the consent of Shaun Hairgrove, the owner. The indictment further alleges, Dupree attempted to commit or committed theft of property including two televisions, one black in color Seki 42" TV and a 14" (brand unknown) black in color TV, both owned by Hairgrove.
  9. Charles David Belsha was indicted for theft, third degree felony. The indictment alleges on June 8, 2017 Belsha took various hand tools, sockets, chainsaw, various batteries, drills, and various other items of the value of $2,500 or more but less than $30,000 from Donnie Borders, the owner, who was then and there an elderly individual.
  10. Brian Dwayne Bittick was indicted for forgery against elderly individual, third degree felony. The indictment alleges, on November 24, 2016, Bittick with intent to defraud or harm another, namely Ernest Wayne Bittick, an elderly individual 65 years of age or older, altered, made, executed, authenticated, or completed a writing so it purported to be the act of Ernest Wayne Bittick. The indictment further alleges, Ernest Wayne Bittick did not authorize the act and said writing were checks paid to the order of Brian Bittick totaling $950.
  11. Joey Lynn Garner was indicted for assault family violence with prior conviction, third degree felony. The indictment alleges on May 10, 2018 Garner recklessly caused bodily injury to Sally Reynolds, a member of Garner's family, by striking Reynolds repeatedly with his hands. It is further alleged, Garner was previously convicted of a similar offense on September 5, 2014.
  12. James Melvin Fleming was indicted for possession of a prohibited weapon, third degree felony enhanced to second degree felony (prior felony conviction). The indictment alleges on April 19, 2018 Fleming possessed a 20 gauge shotgun that is a short barrel firearm. It was further presented in the indictment, on February 19, 1974, in Shelby County Fleming was convicted of the felony offense of arson.
  13. Aubrey Neal Graves was indicted for abandoning or endangering a child, state jail felony. The indictment alleges on January 11, 2018 Graves engaged in conduct that placed a child younger than 15 years of age in imminent danger of death, bodily injury, or physical or mental impairment by exposing the child to methamphetamine. The indictment further alleges, Graves' conduct related to the proximity or accessibility of the methamphetamine to the child, and an analysis of a specimen of the child's blood, urine, or other bodily substance indicated the presence of methamphetamine in the child's body.
  14. David Godwin was indicted for aggravated assault, second degree felony. The indictment alleges on November 29, 2017 Godwin recklessly threatened Leslie Hodge with imminent bodily injury when Godwin attempted to run Hodge over in a motor vehicle. The indictment further states, Godwin used or exhibited a weapon at that time which was a white Suburban vehicle, during the commission of the assault.
  15. James Cody Fleming was indicted for theft, state jail felony. The indictment alleges on June 13, 2017 Fleming took a Generac 10000 EXL generator valued at $750 or more but less than $2,500 from Frances Byrd, the owner.

  17. Kindrick Lee Davis was indicted for engaging in organized criminal activity, state jail felony. The indictment alleges on February 1, 2018 Davis without the consent of Dale Scates, the owner, broke into or entered a vehicle or a part thereof with the intent to commit theft. The indictment further alleges, Davis conspired to commit burglary of a vehicle with the intent to establish, maintain, or participate in a combination, or in the profits of a combination along with Debriyonia Miller, Jamarcus Suell, and/or other individuals who collaborated in carrying on said criminal activity.
  18. Jeremy Lee Fountain was indicted for burglary of a habitation, second degree felony. The indictment alleges on February 5, 2018 Fountain entered a habitation without consent of Jordin Fountain, the owner, and attempted to commit or committed theft of a hamper full of clothes and a jar containing $27, owned by Jordin Fountain.
  19. Kiesha Lynn Allred was indicted for burglary of a building, state jail felony. The indictment alleges on December 12, 2017 Allred entered a building or a portion of a building without the consent of Benjamin Wade Bowlin, the owner. The indictment further alleges Allred attempted to commit or committed theft of a mini black refrigerator, red Lincoln welding machine, Stanley upright toolbox, black and yellow Skill saw, black air compressor, misc. hand tools and power tools (wrenches, grinders, drills), and a tan and black four-wheeler owned by Benjamin Wade Bowlin.
  20. Kiesha Lynn Allred was indicted for burglary of a habitation, second degree felony. The indictment alleges on December 12, 2017 Allred entered a building or a portion of a habitation without the consent of Benjamin Wade Bowlin, the owner. The indictment further alleges Allred attempted to commit or committed theft of a black 50" Samsung television, a gray safe, and a 39" television owned by Benjamin Wade Bowlin.
  21. Michael Ray Allison was indicted for obstruction or retaliation, third degree felony. The indictment alleges on May 29, 2017 Allison threatened to harm David Allison by stating he would kill David Allison. The indictment further alleges, this was done in retaliation for or on account David Allison reported the occurrence of a crime.
  22. Michael Ray Allison was indicted for aggravated assault, second degree felony. The indictment alleges on May 29, 2017 Allison recklessly caused serious bodily injury to David Wayne Allison by striking him in the face and choking him until he could not breathe. The indictment further alleges Michael Ray Allison used or exhibited a Remington 870 Magnum 20 gauge shotgun during commission of the assault. David Wayne Allison is also a member of Michael Ray Allison's family as described in the Family Code.
  23. Michael Ray Allison was indicted for assault by occlusion, third degree felony. The indictment alleges on May 29, 2017 Allison recklessly caused bodily injury to David Wayne Allison by striking him in the face and choking him until he could not breathe. David Wayne Allison is also a member of Michael Ray Allison's family as described in the Family Code.
  24. Alfredo Serrano was indicted for aggravated assault, second degree felony. The indictment alleges on June 2, 2018 Serrano recklessly caused bodily injury to Maria Janet Rodriguez by cutting her and Serrano did then exhibit a large black handle kitchen knife during the assault.
  25. Alfredo Serrano was indicted for abandoning or endangering a child, state jail felony. The indictment alleges on June 2, 2018 Serrano recklessly or with criminal negligence, engaged in conduct that placed a child younger than 15 years of age in imminent danger of death, bodily injury, or physical or mental impairment, by threatening to kill the child and by assaulting the mother with a kitchen knife in the presence of the child.
  26. Chad Justin Taylor was indicted for assault - prior conviction, third degree felony. The indictment alleges on September 12, 2017 Taylor recklessly caused bodily injury to Wayne Taylor Sr., a member of Chad Justin Taylor's family, by punching him in the face with a closed fist. The indictment further indicates Chad Justin Taylor was previously convicted of a similar offense on May 17, 2016.
  27. Albert Ronald Burrell was indicted for evading arrest, third degree felony. The indictment alleges on March 4, 2018 Burrell intentionally fled in a vehicle from Texas Department of Public Safety State Trooper Jesse Fountain, a person Burrell knew was a peace officer who was attempting to lawfully arrest or detain Burrell.
  28. Sylvia Jeanne Kealaula was indicted for unlawful restraint, third degree felony. The indictment alleges on April 23, 2017 Kealaula restrained a child younger than 17 years of age but older than 14 years of age. It is further alleged in the indictment this was done by taking the child out of the State of Texas and outside a 120-mile radius from the child's residence, and the child's father had not acquiesced to the child going or remaining with Sylvia Kealaula.
  29. Angela Michelle Read was indicted for unlawful restraint, third degree felony. The indictment alleges on May 1, 2017 Read restrained a child younger than 14 years of age from her mother Junie Bynum without her consent, by restricting the movements of the child to wit: failing to return the child back to its mother.
  30. Brandon Wayne Inglis was indicted for unlawful restraint, third degree felony. The indictment alleges on May 1, 2017 Inglis restrained a child younger than 14 years of age from her mother Junie Bynum without her consent, by restricting the movements of the child to wit: failing to return the child back to its mother.
  31. Dwayne Kade Dockens was indicted for criminal mischief, state jail felony. The indictment alleges on April 30, 2017 Dockens damaged or destroyed a 2010 Ford F150 pickup truck owned by Bryce Harris and without consent of Harris. Dockens is alleged to have caused pecuniary loss of $2,500 or more but less than $30,000 to Harris.
  32. Eric Meneguildo Perez was indicted for criminal mischief, state jail felony. The indictment alleges on April 30, 2017 Perez damaged or destroyed a 2010 Ford F150 pickup truck owned by Bryce Harris and without consent of Harris. Perez is alleged to have caused pecuniary loss of $2,500 or more but less than $30,000 to Harris.
  33. David Earl Kelley was indicted for burglary of a habitation, second degree felony. The indictment alleges on May 13, 2017 Kelley entered a habitation without the consent of R.E. Shofner, the owner. It's further alleged in the indictment Kelley attempted to commit or committed theft of property, to-wit: Mossberg 12-gauge bolt action, Marlin bolt action single shot .22 LR, and/or Winchester bolt action 30-06 rifle, owned by Shofner.
  34. Angela Read McShan was indicted for theft, third degree felony. The indictment alleges on June 8, 2017 McShan took an 80 gallon bladder tank with epoxy coating, trailer tire, rear lights and license plate, archway with swinging gates, 36" concrete birdbath, and/or four ratchet straps, the value of which is collectively $2,500 or more but less than $30,000, from David Murrell Armstrong, the owner. The indictment further alleges Armstrong was at that time an elderly individual.
  35. Roy Michael Oden was indicted for theft, state jail felony. The indictment alleges on June 3, 2017 Oden took copper valued at less than $20,000 from Jeffery Rodgers, the owner, without consent. 
  36. Candy Ray Oden was indicted for theft, state jail felony. The indictment alleges on June 3, 2017 Oden took copper valued at less than $20,000 from Jeffery Rodgers, the owner, without consent. 
  37. Jeffery Scott Wright was indicted for evading arrest, third degree felony. The indictment alleges on July 28, 2017 Wright used a vehicle to flee from Shelby County Sheriff's Deputy Michael Griffin.
  38. Laurel Smith was indicted for sexual assault of a child, second degree felony. The indictment alleges on July 15, 2017 Smith caused the penetration of the sexual organ of a child who was then and there younger than 17 years of age and not Smith's spouse.
  39. Robert Lee Miller was indicted for failure to comply with registration requirements, third degree felony enhanced to second degree felony punishment. The indictment alleges on May 26, 2017, because of a reportable conviction for sexual assault of a child and while knowing he was required to register with the local law enforcement authority in the county in which he resides or intends to reside for more than seven days, Miller failed to obtain and/or maintain a yearly renewable state identification card or driver's license.
  40. Mykeltric Jerrod Davis was indicted for aggravated assault, second degree felony. The indictment alleges on July 22, 2017 Davis threatened Talissia Caraway with bodily injury by firing shots into the air in the direction where Caraway was standing. The indictment further alleges Davis used or exhibited a firearm during the commission of the assault.
  41. Joshua Mancill Myers was indicted for unauthorized use of a motor vehicle, state jail felony. The indictment alleges on June 16, 2017 Myers operated an automobile without consent of Joe Singleton, the owner.
  42. Charles Patrick Davis was indicted for burglary of a building, state jail felony. The indictment alleges on July 1, 2017 Davis entered a building or portion of a building without the consent of C. Scott Massey, the owner. It's further alleged in the indictment Davis attempted to commit or committed theft of a red 1988 Honda 300 Foretrax, owned by Massey.
  43. Charles Patrick Davis was indicted for burglary of a building, state jail felony. The indictment alleges on July 1, 2017 Davis entered a building or portion of a building without the consent of C. Scott Massey, the owner. It's further alleged in the indictment Davis attempted to commit or committed theft of a yellow 1998 Honda ES 450 4x4 ATV, owned by Massey.
  44. James Alford Johnson Jr. was indicted for burglary of a building, state jail felony. The indictment alleges on November 4, 2016 Johnson entered a building or portion of a building without consent of Patricia Williams, the owner. The indictment further alleges Johnson attempted to commit or committed theft of a bedding set including pillows and comforter, Barbie doll collection, pink suitcase, black travel bag, back massager, Ozark trail air mattress, two lamps with shades, bath accessories, one resin tumbler, two matching vases with vase fillers, one ionic crystal salt tableland, one jewelry box containing two smaller boxes, two boxes containing assorted kitchenware, three end tables, and/or three bar stools owned by Williams.
  45. Steven Bryan McCoy Jr. was indicted for forgery, state jail felony. The indictment alleges on May 27, 2017 McCoy had intent to defraud or harm another, alter, make, execute, complete or authenticate, a writing so it purported to be the act of Entergy Texas Inc. who did not authorize the act. The indictment further alleges said writing was a check of the tenor following: JP Morgan Chase Bank, Check Account belonging to Entergy Texas Inc. payable to the order of August Stiller in the amount of $721.66.
  46. Bobby Stein was indicted for theft with two prior convictions, class a misdemeanor enhanced to state jail felony. The indictment alleges on October 31, 2015 Stein took a blue 1997 12' bumper pull trailer valued at $750 or more but less than $2,500 from Paul Smith, an elderly man and the owner of the trailer. The indictment further states Stein was previously convicted of theft on two previous occasions.
  47. Joshua Denzel Eaden was indicted for aggravated assault, second degree felony. The indictment alleges on May 8, 2017 Eaden caused bodily injury to Xavier Hewitt by shooting him in the buttocks and during the assault Eaden exhibited a .22 caliber Jimenez handgun.
  48. Darron V. McCollister was indicted for prohibited substances in a correctional facility, third degree felony. The indictment alleges on April 16, 2016 McCollister possessed buspirone hydrochloride while in a correctional facility, Center Police Department. 
  49. Joshua Bernard Blanton was indicted for tampering or fabricating evidence criminal attempt, state jail felony. The indictment alleges on November 9, 2017 Blanton tampered with or fabricated evidence in knowing an investigation or official proceeding was pending or in progress, altered, destroyed, or concealed any record, document or thing with intent to impair itrs verity, legibility, or availability as evidence. The indictment further alleges Blanton stepped on a PCP cigarette inside a car, by attempting to conceal a PCP cigarette under his leg, or by throwing a PCP cigarette on the ground under the passenger side door of a car.
  50. Joshua Bernard Blanton was indicted for tampering or fabricating evidence criminal attempt, state jail felony. The indictment alleges on May 18, 2017 Blanton tampered with or fabricated evidence in knowing an investigation or official proceeding was pending or in progress, altered, destroyed, or concealed any record, document or thing with intent to impair its verity, legibility, or availability as evidence. The indictment further alleges Blanton threw down a clear bottle with a brown/tan colored liquid in it while running from a police officer.
  51. Brian Dwayne Bittick was indicted for unauthorized use of a motor vehicle, state jail felony. The indictment alleges on May 29, 2017 Bittick operated an automobile without consent of Isidro Lopez, the owner.
  52. Anthony Oneal Jones was indicted for aggravated assault, second degree felony. The indictment alleges on July 3, 2017 Jones recklessly caused bodily injury or serious bodily injury to Ladetris Caldwell by striking her in the head, chest, and arms with a closed fist. The indictment further alleges Jones used or exhibited a knife during commission of the assault.
  53. Tony Joshua Parker was indicted for abandoning or endangering a child, state jail felony. The indictment alleges on July 17, 2017 Parker engaged in conduct that placed a child younger than 15 years of age in imminent danger of death, bodily injury, or physical or mental impairment, by removing her from a crashed vehicle and taking her into the woods thereby preventing medical treatment for possible injuries sustained in the crash.
  54. Shae Machell Husband was indicted for forgery - against elderly individual, second degree felony. The indictment alleges on July 7, 2016 Husband had intent to defraud or harm another namely, Nell Hutchins, an elderly individual 65 years of age or older. The indictment further alleges Husband altered, completed, executed, or authenticated a writing so that it purported to be the act of Hutchins, who did not authorize the act. The said writing was a personal check drawn on a Texas State Bank account for the amount of $350 made out to Husband and cashed at Woodforest National Bank.
  55. Kristi Lynn Stringer was indicted for diversion of controlled substance, state jail felony. The indictment alleges on May 5, 2017 Stringer diverted or converted to her use or benefit a controlled substance, hydrocodone, to which Stringer had access by virtue of her employment at Jordan Services, as provider for Mary Walker.
  56. Christy Michelle Patton was indicted for theft, state jail felony. The indictment alleges on June 1, 2017 Patton took miscellaneous merchandise and food products valued at $750 or more but less than $2,500 from Wal-Mart, the owner. The indictment further states Patton was twice previously convicted of theft in April 2010 and January 2011.
  57. Christy Michelle Patton was indicted for theft, state jail felony. The indictment alleges on July 1, 2017 Patton took miscellaneous merchandise and food products valued at $750 or more but less than $2,500 from Wal-Mart, the owner. The indictment further states Patton was twice previously convicted of theft in April 2010 and January 2011.
  58. Christy Michelle Patton was indicted for theft, state jail felony. The indictment alleges on July 6, 2017 Patton took miscellaneous merchandise and food products valued at $750 or more but less than $2,500 from Wal-Mart, the owner. The indictment further states Patton was twice previously convicted of theft in April 2010 and January 2011.
  59. Matthew R. Reynolds was indicted for evading arrest, third degree felony. The indictment alleges on April 19, 2017 Reynolds used a vehicle to intentionally flee Center Police Officer Jacob Gross, whom Reynolds knew was attempting to lawfully arrest or detain him.
  60. Antonio Bernard Richardson, Jr., was indicted for theft, state jail felony. The indictment alleges on May 5, 2017 Richardson took two 50" Vizio TVs, two 65" Samsung TVs, one HP ALO desktop computer, three HP 22 ALO desktop computers, four Nest Hope cameras with a collective value of $2,500 or more but less than $30,000 from Wal-Mart, the owner.
  61. Antonio Bernard Richardson, Jr., was indicted for engaging in organized criminal activity, third degree felony. The indictment alleges on May 5, 2017 Richardson with intent to establish, maintain, or participate in a combination or in the profits of a combination. The said combination consisting of Richardson, David Lee Gray, Kendall Dixon, who collaborated in carrying on the hereinafter described criminal activity, conspire to commit or commit the offense. Richardson, Gray, and Dixon performed one or more overt act in pursuance of said agreement of acquiring or otherwise exercising control over said property including televisions, computers, and/or various other electronics from Wal-Mart.
  62. Andrea Kalise Starghill was indicted for credit card/debit card abuse, state jail felony. The indictment alleges on May 13, 2017 Starghill fraudulently presented or used a credit card or debit card which had not been issued to Starghill. The indictment further alleges Starghill did this without consent of the cardholder, Barbara P. Smith, or did then and there steal a credit card or debit card with intent to use it, a Mastercard.
  63. Andrea Kalise Starghill was indicted for fraudulent use or possession of identifying information, third degree felony - second degree felony on punishment. The indictment alleges on May 13, 2017 Starghill had intent to harm or defraud another, obtain, possess, transfer, or use five or more, but less than 10 items of identifying information belonging to Barbara P. Smith, an elderly individual, without her consent. The indictment further alleges the information included name, date of birth, address, bank routing code, financial institution account number, driver's license number, medicare number, social security number, credit card account numbers on one or more of the following: Barbara P. Smith's driver's license, social security card, Medicaid card, checks on her personal financial account, Mastercard, and credit cards for the following entities: Bealls, JCPenney, Walmart, Lowes, Burkes and Gordon's Jewelry.
  64. Marcus Dewayne Taylor was indicted for credit card/debit card abuse, state jail felony. The indictment alleges on June 29, 2017 Taylor while intent on obtaining benefit fraudulently, presented or used a debit or credit card, Mastercard, that had not been issued to Taylor. The indictment further alleges Wytavia Jones, the owner, did not give consent for use by Taylor.
  65. Christopher Lee Oliver was indicted for unauthorized use of a motor vehicle, state jail felony. The indictment alleges on April 5, 2017 Oliver operated an automobile without the consent of Shirley Lemon, the owner.

  • Ronny Joe Beard, driving while intoxicated - 3rd or more, third degree felony (April 15, 2018).
  • Radley Lamar Brock, driving while intoxicated - 3rd or more, third degree felony (November 10, 2017). 
  • Sammy Bruce Samford, driving while intoxicated - 3rd or more, third degree felony (June 6, 2018).
  • Charles Henry Bennett, driving while intoxicated - 3rd or more, third degree felony (May 16, 2017).
  • Bobbi Paulene Costello, possession of a controlled substance (methamphetamine), third degree felony (October 19, 2017).
  • Preston Jermaine Powers, possession of a controlled substance (MDMA/Ecstasy), first degree felony (May 30, 2018).
  • Preston Jermaine Powers, possession of a controlled substance with intent to deliver (cocaine), first degree felony (May 30, 2018).
  • Andrew Scott Elliott, possession of a controlled substance (methamphetamine), third degree felony (July 11, 2017).
