Shelby County Grand Jury Indicts 36 Cases

February 24, 2016 - The Shelby County grand jury for the January Term 2016 of the 273rd Judicial District Court met Tuesday, February 23, 2016 and indicted 36 cases with all cases presented receiving indictment.

Louis Claude McGinty received indictment for aggravated assault with a deadly weapon, second degree felony. According to the indictment on or about September 9, 2015 McGinty allegedly threatened John Luk Kindred with imminent bodily injury by pulling a firearm and pointing it in the direction Kindred, and the defendant did then and there use or exhibit a deadly weapon, namely a firearm.

Spencer Ryan Niedert was indicted for aggravated assault with a deadly weapon, second degree felony. The indictment alleges on or about May 1, 2015 Niedert caused bodily injury to Ryan Blake Eddins by shooting at and striking the vehicle of Eddins while driving along the highway.

Iva Mikesh was indicted for injury to a child, elderly or disabled individual, third degree felony. The indictment alleges on or about August 10, 2015 Mikesh caused bodily injury to a child 14 years of age or younger, by biting the victim's arm.

Raymond Mikesh was indicted for retaliation, third degree felony. The indictment alleges on or about September 18, 2015 Mikesh threatened to harm Carriston Renee Hendricks by assault in retaliation for or on account of the service of Carriston Renee Hendricks, as a person who had reported the occurrence of a crime.

Marcus Lee Olivas received an indictment for burglary of a habitation, second degree felony. The indictment alleges on or about July 1, 2015 Olivas entered a habitation with intent to commit theft without the consent of the owner, Olga McDonald.

Tavoris Giles was indicted for aggravated assault of a peace officer, first degree felony. The indictment alleges on or about May 12, 2014 Giles threatened Center Police Detective Chris Knowlton with imminent bodily injury by pushing him to the ground, and exhibited a handgun during the assault. It also stated Giles was aware at that time Knowlton was a public servant. Giles was also indicted for delivery of a controlled substance, first degree felony. The indictment alleges on or about May 12, 2014 Giles delivered cocaine, by constructive transfer, in the amount of 4 grams or more but less than 200 grams.

Giles also was indicted for delivery of a controlled substance, first degree felony. The indictment alleges on or about May 12, 2014 Giles delivered methadone, by constructive transfer, in the amount of 4 grams or more but less than 200 grams. Giles was also indicted for delivery of marijuana, third degree felony. The indictment alleges on or about May 12, 2014 Giles delivered marijuana, by constructive transfer, in the amount of 50 pounds or less but more than five pounds. Giles was also indicted for money laundering, state jail felony. The indictment alleges on or about May 12, 2014 Giles possessed the proceeds of criminal activity by way of 87 $100 bills from inside of a white air-freshener on his bedroom wall. The value of said funds was $1,500 or more but less than $20,000.

Leonard Blackshire was indicted for delivery of marijuana, third degree felony. The indictment alleges on or about May 12, 2014 Blackshire possessed a usable quantity of marijuana in an amount of five pounds or less but more than four ounces. Blackshire was also indicted for delivery of a controlled substance, first degree felony. The indictment alleges on or about May 12, 2014 Giles delivered cocaine, by constructive transfer, in the amount of 4 grams or more but less than 200 grams. Blackshire was also indicted for delivery of a controlled substance, first degree felony. The indictment alleges on or about May 12, 2014 Giles delivered cocaine, by constructive transfer, in the amount of 4 grams or more but less than 200 grams.

Joshua LaKeith Harper was indicted for delivery of a controlled substance, first degree felony. The indictment alleges on or about February 5, 2015 Harper delivered a controlled substance, phencyclidine (PCP), in an amount of four grams or more but less than 200 grams to a confidential source by constructive transfer. Harper was also indicted for delivery of a controlled substance,state jail felony. The indictment alleges on or about February 5, 2015 Harper delivered a controlled substance,"crack" cocaine in an amount of less than one gram to a confidential source by constructive transfer. Harper was also indicted for delivery of a controlled substance, third degree felony. The indictment alleges on or about February 5, 2015 Harper delivered a controlled substance,"crack" cocaine in an amount of less than one gram to a confidential source by actual transfer.

Tristan Derae Patton was indicted for delivery of a controlled substance, first degree felony - penalty is enhanced. The indictment alleges on or about February 5, 2015 Patton delivered a controlled substance, phencyclidine (PCP), in an amount of less than one gram to a confidential source by constructive transfer. It is further presented he did this within 1,000 feet of Perry Sampson Park.

Tristan Derae Patton was indicted for delivery of a controlled substance, first degree felony - drug free zone - penalty is enhanced. The indictment alleges on or about February 5, 2015 Patton delivered a controlled substance, methamphetamine, in an amount of less than one gram to a confidential informant by constructive transfer. It is further presented he did this within 1,000 feet of Perry Sampson Park. Patton was also indicted for tampering with or fabricating physical evidence, third degree felony. The indictment alleges in February 5, 2015 Patton was aware an investigation or official proceeding was in progress, narcotics search warrant, and that he altered, destroyed, concealed a record or document or thing. Namely, illegal narcotics with intent to impair its verity, legibility or availability as evidence in the investigation or official proceeding.

Joseph Obryan Land was indicted for delivery of a controlled substance, state jail felony - drug free zone - penalty is enhanced. The indictment alleges Land on or about February 5, 2015 delivered a controlled substance, methamphetamine, in an amount of less than one gram to a confidential informant by constructive transfer. It is further presented he did this within 1,000 feet of Perry Sampson Park.

Justin Earl Bennett was indicted for delivery of a controlled substance, third degree felony. According to the indictment on or about February 5, 2015 Bennett delivered "crack" cocaine to a confidential source by actual transfer in an amount of less than one gram. Bennett was also indicted for delivery of a controlled substance, first degree felony. According to the indictment on or about February 5, 2015 Bennett delivered phencyclidine (PCP) to a confidential source by actual transfer in an amount of four grams or more but less than 200 grams.

Justin Earl Bennett was indicted for delivery of a controlled substance, state jail felony. According to the indictment on or about February 5, 2015 Bennett delivered "crack" cocaine to a confidential source by actual transfer in an amount of less than one gram.

Andy Stephens was indicted for aggravated sexual assault of a child, first degree felony. According to the indictment on or about August 7, 2015 Stephens allegedly penetrated the female organ of a child who was then and there younger than 14 years of age and not the spouse of the defendant, by defendant's finger.

Dawn Bradshaw Collins was indicted for aggravated sexual assault, first degree felony - enhanced minimum of 25 years. According to the indictment on or about July 9, 2015 Collins allegedly caused the sexual organ of a child who was then and there younger than 6 years of age to penetrate the mouth of the defendant.

Carl Edgar Whillock was indicted for indecency with a child, second degree felony. According to the indictment on or about June 7, 2015 Whillock allegedly with intent to arouse or gratify the sexual desire of himself, engaged in sexual contact by touching the genitals of a child younger than 17 years and not the spouse of the defendant.

Pedro Lopez-Ovilla received indictment for sexual assault of a child, second degree felony. The indictment alleges on or about December 6, 2015 Lopez-Ovilla caused the penetration of the sexual organ of a child who was then and there younger than 17 years of age and not the spouse of Lopez-Ovilla, by his sexual organ.

Maria Ann Hammers was indicted for indecency with a child - exposure, third degree felony. According to the indictment on or about August 29, 2015 Hammers allegedly exposed her genitals to a child younger than 17 years of age. Hammers was also indicted for indecency with a child, second degree felony. The indictment alleges on September 10, 2015 Hammers caused a child younger than 17 years of age to engage in sexual contact by causing the child to touch the breasts of Hammers.

Joseph Aldaco received an indictment for aggravated sexual assault of a child, first degree felony. According to the indictment on or about July 18, 2015 Aldaco caused the penetration of the female sexual organ of a child younger than 14 years of age, and not the spouse of Aldaco, by his sexual organ.

Jessica Griffin was indicted for aggravated sexual assault, first degree felony. The indictment alleges on or about July 18, 2015 Griffin caused the penetration of the female sexual organ of a child younger than 14 years of age, by the sexual organ of Joseph Aldaco (Joseph Aldaco's indictment listed above.)

Juan Manuel Aldaco Jr. received indictment for aggravated sexual assault, first degree felony. The indictment alleges on or about July 18, 2015 Aldaco caused the penetration of the female sexual organ of a child younger than 14 years of age, by the sexual organ of his brother Joseph Aldaco (Joseph Aldaco's indictment listed above.)
