SC Grand Jury Hands Down 31 Indictments

January 25, 2023 - A Shelby County Grand Jury handed down 31 indictments on Monday, January 9, 2023. The grand jury was impaneled for the January 2023 term of the 123rd/273rd Judicial District Courts.

Sakendrick Jacobe Calhoun was indicted for forgery, third degree felony. The indictment alleges, on December 29, 2021, Calhoun possessed a writing that had been forged with intent to use, transfer, pass, publish, otherwise utter said writing which was purported to be a one hundred dollar bill. Brent Nicholson was indicted for burglary of a habitation intending to commit a felony, first degree felony. The indictment alleges, on September 10, 2020, Nicholson intended to commit the felony offense of assault causing bodily injury, and entered a habitation without the consent of Natalie Hutton, the owner. Rhonald Palmer was indicted for aggravated assault causing serious bodily injury, second degree felony. The indictment alleges, on May 19, 2022, Palmer knowingly caused bodily injury to Manuel Jimenez by striking him in the left thigh with a baseball bat and did then and there point a Ruger 22 long rifle at Jimenez and fired it toward his legs. Jimmy Moore was indicted for prohibited sexual conduct, third degree felony. The indictment alleges, on February 4, 2022, Moore engaged in sexual intercourse with a person Moore knew to be, without regard to legitimacy, his stepchild. (273rd Judicial District Court)

Wanda Moore was indicted for prohibited sexual conduct, third degree felony. The indictment alleges, on February 4, 2022, Moore engaged in sexual intercourse with a person Moore knew to be, without regard to legitimacy, her daughter. (273rd Judicial District Court)

Katina Marshal Evans was indicted for tampering with physical evidence, third degree felony. The indictment alleges, on May 18, 2022, while Evans knew an investigation was ongoing into a possible possession of a controlled substance, she allegedly attempted to conceal an illegal drug (baggie of marijuana) with intent to impair its availability as evidence in the investigation by throwing it under a car. Jeffrey Walling was indicted for assault by choking, third degree felony. The indictment alleges, on June 12, 2022, Walling knowingly caused bodily injury to Angela Walling, a member of Jeffrey Walling’s family, by impeding the normal breathing of circulation of the blood of Angela Walling by applying pressure to the throat or neck. Jeffrey Walling also allegedly tossed her around causing bruising to both arms. (123rd Judicial District Court)

Breanne Rascoe was indicted for abandoning or endangering a child, state jail felony. The indictment alleges, on June 24, 2022, Rascoe engaged in conduct that placed a child younger than 15 years of age in imminent danger of death, bodily injury, or physical or mental impairment by driving while intoxicated with the child in the vehicle. Tracey Lyn Hebert was indicted for accident involving serious bodily injury, third degree felony. The indictment alleges, on March 18, 2022, after having been involved in an accident that Hebert knew was reasonably likely to result in injury to or death of a person, and after having determined another person was involved in the incident, failed to immediately determine whether that person required aid. The incident resulted in the bodily injury to Callie Adams. (123rd Judicial District Court)

Caster Moore was indicted for evading arrest with a motor vehicle, third degree felony. The indictment alleges, on July 1, 2022, Moore used a vehicle to intentionally flee Fern Jernigan, a person Moore knew was a peace officer who was attempting to lawfully arrest or detain him. Tyreik Odums was indicted for burglary of a habitation, second degree felony. The indictment alleges, on August 23, 2022, Odums entered a habitation without the consent of Manuel Leon and Maria Leon, the owners, and attempted to commit or committed theft of a black safe with miscellaneous items inside (credit cards, identification cards, trailer title, jewelry) owned by Leons. Tyreik Odums was indicted for engaging in organized criminal activity, first degree felony. The indictment alleges, on August 23, 2022, Odums had intent to establish, maintain, or participate in a combination or in the profits of a combination which consisted of Odums, Trevor May, Justin Bigger, and Jacob Jones. The indictment further alleges they collaborated in carrying on and conspired to commit the offense of burglary of a habitation by agreeing with each other that they would engage in conduct that constituted the offense. The indictment further alleges Odums, May, Bigger and Jones allegedly performed an overt act in pursuance of the agreement namely intentionally and knowingly entering a habitation without effective consent of Manuel Leon and Mario Leon, the owners, and attempted to commit or committed theft of a black safe with miscellaneous items inside (credit cards, identification cards, trailer title, jewelry) owned by Leons. The indictment alleges, on August 23, 2022, May had intent to establish, maintain, or participate in a combination or in the profits of a combination which consisted of May, Justin Bigger, Tyreik Odums, and Jacob Jones. The indictment further alleges they collaborated in carrying on and conspired to commit the offense of burglary of a habitation by agreeing with each other that they would engage in conduct that constituted the offense. The indictment further alleges May, Bigger, Odums and Jones allegedly performed an overt act in pursuance of the agreement namely intentionally and knowingly entering a habitation without effective consent of Manuel Leon and Mario Leon, the owners, and attempted to commit or committed theft of a black safe with miscellaneous items inside (credit cards, identification cards, trailer title, jewelry) owned by Leons. Jamal Dash Boyd was indicted for abandoning or endangering a child, state jail felony. The indictment alleges, on August 30, 2022, Boyd engaged in conduct that placed a child younger than 15 years of age in imminent danger of death, bodily injury, or physical or mental impairment, by breaking windows and causing glass to cut the child’s forehead. Derrick Wyatt was indicted for engaging in organized criminal activity, second degree felony. The indictment alleges, on July 6, 2021, Wyatt established, maintained, or participated in a combination or in the profits of a combination which consisted of Wyatt, Zenas Whitaker, Shanan Lee, and John McDaniel who collaborated in carrying on the hereinafter described criminal activity. The indictment further alleges the group conspired to commit the offense of prohibited substance in a correctional facility by agreeing with each other they would engage in conduct that constituted said offense. Wyatt, Whitaker, Lee, and McDonald performed an overt act in pursuance of said agreement by successfully brining methamphetamine into the Shelby County Sheriff’s Jail. Yesenia Cordova was indicted for theft of metals <$30K, state jail felony. The indictment alleges, on February 3, 2022, Cordova took copper of the value of less than $30,000 from James Russell Miles, the owner, without Miles consent. (123rd Judicial District Court)

James Fuchsberger was indicted for aggravated sexual assault, first degree felony. The indictment alleges, on April 1, 2022, Fuchsberger caused the penetration of the mouth, with his sexual organ, of a child who was then and there younger than 14 years of age and not the spouse of Fuchsberger. Gregory Johnson was indicted for sexual assault, second degree felony. The indictment alleges, on January 19, 2021, Johnson caused the penetration of the female organ of an individual without the consent of that individual. (273rd Judicial District Court)
