March 24, 2016 - The Shelby County grand jury for the January Term 2016 of the 273rd Judicial District Court met Tuesday, March 23, 2016 and indicted 29 cases.
A murder investigation which began on January 19, 2016 has resulted in the sister of the victim receiving two indictments with one being for murder. The Shelby County Sheriff's Office received a 911 call in reference to the shooting incident which occurred on FM 417 West in Center. Shelby County Sheriff's department and Center Police Department officers all responded to the incident and discovered Joshua Kellum, 33, of Timpson had been critically shot.
Jennifer Johnson received two indictments pertaining to the same incident. The first indictment for murder, first degree felony, alleges on January 19, 2016 Johnson was criminally responsible for the act of another, namely, aggravated assault with a deadly weapon. In the course of and in furtherance of the commission or attempt, or in immediate flight from the commission or attempt, she committed or attempted to commit an act clearly dangerous to human life that caused the death of an individual, namely, Joshua Kellum by introducing a pistol into an altercation that she instigated.
The second indictment of Johnson for aggravated assault with a deadly weapon, first degree felony, alleges on January 19, 2016 Johnson was criminally responsible for the act of another for the offense of aggravated assault with a deadly weapon. The indictment stated Johnson intentionally, knowingly, and/or recklessly caused bodily injury to Marcus Wayne Evans by striking him in the head, and that during the commission of said assault, Johnson (and another to whose actions she is criminally responsible) did then and there use or exhibit a deadly weapon, a crescent wrench and a Smith and Wesson stainless revolver, during the commission of the assault.
Margie Nicole Stahl and Summer Wheless were each indicted on equal charges in relation to the same incident. According to the first indictment for aggravated kidnapping, first degree felony, on or about March 21, 2015 Stahl and Wheless abducted Bryan Keith Owens by restricting Owens' movements without his consent so as to interfere substantially with his liberty. This was allegedly done by confining him with the intent to prevent him liberation, by using or threatening to use deadly force, namely, by participating in holding Owens against his will after he had been struck with a firearm and taking off his clothing to search his person at gunpoint rendering him incapable of escape and/or defense.
The second set of indictments pertaining to Stahl and Wheless were also for aggravated kidnapping, first degree felony, on the same date as the previous indictments. The indictments allege Stahl and Wheless abducted Nichole Sheree Rhoades by restricting Rhoades' movements without her consent so as to interfere substantially with her liberty. This was allegedly done by confining her with the intent to prevent her liberation, by using or threatening to use deadly force, namely, by participating in holding Rhoades against her will after she had been struck as well as kicked on and about the torso and face, after her ankles and wrists had been duct-taped and tied with rope rendering her incapable of escape and/or defense.
Brantley Sullivan received three separate indictments. The first indictment for assault, third degree felony alleges on or about October 3, 2015 Sullivan caused bodily injury to a female victim, a person with whom the defendant had or has had a dating relationship, by impeding the normal breathing or circulation of blood of the victim by applying pressure to the throat or neck of the victim. The second indictment for stalking, third degree felony, alleges on or about October 14, 2015 Sullivan sent repeated electronic communications of the victim posing nude in photographs along with messages trying to locate her, and Sullivan's said conduct would cause any reasonable person to, and did cause the victim, to be placed in fear of bodily injury or death or feel harassed, annoyed, alarmed, tormented, embarrassed, or offended. Furthermore, the victim received messages where Sullivan stated he was missing work to go to the victim's job so he could hang out at the victim's work watching to see her.
The third indictment of Sullivan for improper photography or visual recording, state jail felony, alleges on or about October 14, 2015 Sullivan promoted a photograph of the victim by electronic means via social media, broadcasted or transmitted a visual obscene image of the victim without her consent and with intent to arouse or gratify the sexual desire of the defendant or another.
Rodney Paul Brittain was indicted for aggravated assault with a deadly weapon, second degree felony. The indictment alleges on or about March 11, 2015 Brittain threatened Andrea Janise Chadwick with imminent bodily injury by threatening to kill her while waiving a weapon at or near her head, then discharging the weapon inside a garage striking the ceiling, and Brittain did then and there use or exhibit a deadly weapon, an Arminuis HW38 .38 caliber revolver, during the commission of said assault.
Larry Wayne Cartwright was indicted for assault - prior conviction, third degree felony. The indictment alleges on or about August 12, 2015 Cartwright caused bodily injury to Shelia Ann Cartwright, a member of the defendant's family, by hitting her in the mouth with a closed fist. Before the commission of the charged offense, the defendant had previously been convicted of an offense against a member of the defendant's family on May 21, 2013.
Linda Parent was indicted for burglary of a building, state jail felony. The indictment alleges, on or about September 9, 2015 Parent entered a building without the consent of Nathan Anding, the owner. The indictment also alleges Parent attempted to commit or committed theft of a red five gallon gas can, 1 1/12 gallon gas can, two eight ounce gallon gas cans, and a four-way tire tool owned by Anding.
Jody Samuel Haley was indicted for credit card/debit card abuse, state jail felony. The indictment alleges, on or about October 16, 2015 Haley used a Woodforest Credit Card belonging to Judy A. Reynolds, the owner, without Reynolds' consent.
Derrek Hughes was indicted for theft, third degree felony. The indictment alleges, on or about October 29, 2015 Hughes took a black Brahman cross cow with horns with a 2-C brand, and a white faced cow with no horns, aggregate value of less than $150,000, stolen during a single transaction from Jeff Cooks, the owner, without his consent.
Chad Pridgen was indicted for criminal mischief, state jail felony. The indictment alleges on or about September 29, 2015 Pridgen tampered with a meter loop (electric meter device) without the consent of Deep Texas Electric Cooperative, Inc., (DETEC) the owner. Pecuniary damage was caused as a result in the amount of $2,500 or more but less than $30,000 to DETEC when Pridgen allegedly diverted or caused to divert, in whole or part, public power supply by utilizing a set of orange jumper cables that had been clamped to the electric line and the breaker box wherein it was joined in the junction terminals.
Travis Wayne Patton, Jr. was indicted for two theft of firearm, state jail felony, charges. The indictment alleges on or about July 27, 2015 Patton took a firearm from Justin Causey, the owner, without the consent of Causey and with intent to deprive Causey of his property. The second indictment alleges on or about July 27, 2015 Patton took a firearm from Joseph Welch, the owner, without his consent.
Jasmine Tyrisha Moore received two indictments for forgery, state jail felony. The indictment alleges on or about September 5, 2015 Moore executed a writing so it purported to be the act of William Emerson, who did not authorize the act, and said writing was a check of the tenor following: Texas State Bank checking account belonging to HLH Timber Company, LLC. made payable to the order of William Emerson in the amount of $354.63. The second indictment on or about the same date was a check of the tenor following: Texas State Bank checking account belonging to HLH Timber Company, LLC. made payable to the order of William Emerson in the amount of $400.
Gina Graves Furra received four separate indictments. The first indictment for burglary of a habitation, second degree felony, alleges on or about July 15, 2015 Furra entered a habitation without the consent of George and/or Geneva Burns, the owners, with intent to commit the felony offense of forgery. The second indictment for theft, state jail felony, alleges on or about July 21, 2015 Furra took a 2004 Pontiac Grand Am of the value of $1,500 or more but less than $20,000 from Perry Auto, the owner, without the consent of Perry Auto.
Furra's third indictment for credit card/debit card abuse against the elderly, third degree felony, alleges on or about January 27, 2015 Furra with intent to fraudulently obtain a benefit presented to Walmart Supercenter Chase Slate Credit Card with knowledge that the card had not been issued to Furra, and with the knowledge that the card was used without consent of George Burns, the cardholder. The fourth indictment was for credit card/debit card abuse against the elderly, third degree felony. The indictment alleges on March 16, 2016 Furra took a credit card, namely American Express, from Geneva Burns, the owner, without her consent.
Kinshana Kaundra Cartwright was indicted for forgery, third degree felony. The indictment alleges on or about January 27, 2015 Cartwright passed to Elizabeth McDonald (Scarber's Grocery) a forged writing, knowing such writing to be forged and such writing had been so altered, made, completed, executed and/or authenticated that it purported to be the act of the United States Federal Reserve, who did not authorize the act, and said writing was counterfeit currency of the tenor following: a counterfeit one hundred dollar bill.
John Alford Johnson, Jr. was indicted for injury to a child, elderly or disabled individual, third degree felony. The indictment alleges on or about April 17, 2015 Johnson caused serious bodily injury to a child 14 years of age or younger, by striking said child.
Robert Jual Harris was indicted for burglary of a habitation, second degree felony. The indictment alleges on May 8, 2015 Harris entered a habitation without the consent of Stacy Spruiell, the owner, and attempted to commit or committed theft of a 50 cc Yamaha motorcycle, Gibson Les Paul guitar and various items of clothing owned by Spruiell.
